Welcome to Kami Collectables. These Terms of Service, together with our Privacy Policy and any other policies posted on our website, govern your access to and use of our website, online store, products, services, promotions, and related content.

By accessing our website, creating an account, placing an order, or purchasing products from Kami Collectables, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or purchase from us.

For the purposes of these Terms, “Kami Collectables,” “we,” “us,” and “our” refer to Kami Collectables. “You,” “your,” and “customer” refer to any person using our website or purchasing products from us.

1. About Kami Collectables

Kami Collectables is a Canadian trading card shop based in Ontario. We sell trading card products, collectibles, accessories, and related items, which may include sealed products, booster boxes, booster packs, elite trainer boxes, tins, collection boxes, deck products, binders, sleeves, top loaders, and, where offered, individual cards or graded cards.

We may sell products from brands and franchises including, but not limited to, Pokémon, Yu-Gi-Oh!, One Piece Card Game, Union Arena, Dragon Ball Super Card Game, and other trading card games. Kami Collectables is an independent retailer and is not affiliated with, sponsored by, or endorsed by Nintendo, The Pokémon Company, Konami, Bandai, Toei Animation, Shueisha, or any other rights holder unless expressly stated.

2. Eligibility to Use Our Website

You must be at least the age of majority in your province, territory, state, or country of residence to place an order with us. If you are under the age of majority, you may only use our website or purchase products with the involvement and consent of a parent or legal guardian.

By using our website or placing an order, you represent that you have the legal authority to enter into these Terms.

3. Account Registration

You may be able to create an account on our website. You agree to provide accurate, current, and complete information when creating an account or placing an order.

You are responsible for maintaining the confidentiality of your account login information and for all activity under your account. You agree to notify us promptly if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate accounts that contain inaccurate information, are used for fraudulent activity, abuse promotions, interfere with our website, or violate these Terms.

4. Product Information and Availability

We try to ensure that product descriptions, images, prices, availability, release dates, and other information on our website are accurate. However, errors may occur.

Product images may be for reference only. Packaging, artwork, language, edition, print run, included items, or manufacturer details may vary slightly from images shown, unless we specifically state otherwise.

Trading card products may contain randomized contents. We do not guarantee specific pulls, card values, rarity outcomes, hit rates, grading results, resale values, or investment performance. Purchasing sealed trading card products involves chance, and the contents are determined by the manufacturer.

All products are subject to availability. We may limit quantities, cancel orders, or refuse sales where necessary, including where there are stock errors, supplier allocation issues, suspected fraud, pricing errors, abuse of promotions, or unusually high-volume purchases.

5. Sealed Product Policy

Unless otherwise stated, sealed trading card products are sold as factory-sealed products.

You are responsible for reviewing the product title, product description, product language, edition, region, condition, and quantity before placing your order. This is especially important for imported Japanese, Korean, Chinese, or other non-English products.

Once sealed product has been opened, tampered with, unwrapped, damaged after delivery, or otherwise altered from its original condition, it cannot be returned or exchanged unless required by applicable law.

We are not responsible for manufacturer collation issues, missing hits, factory print defects, damaged cards inside sealed packaging, poor pull rates, or dissatisfaction with randomized contents. However, where appropriate, we may help direct you to the manufacturer’s support process.

6. Individual Cards, Singles, and Graded Cards

Where Kami Collectables sells individual cards, singles, slabs, or graded cards, product condition will be described as accurately as reasonably possible.

Raw card condition is subjective and may vary slightly from person to person. Any condition description is our good-faith assessment and is not a guarantee that a third-party grading company will assign the same grade or condition.

Graded cards are sold based on the grade and certification shown by the applicable grading company at the time of sale. We do not guarantee future crossover grades, regrades, population changes, market value, or certification database availability.

7. Pricing, Currency, Taxes, and Fees

Unless otherwise stated, prices are listed in Canadian dollars (CAD).

Applicable taxes, shipping charges, and any other required charges will be shown before you complete checkout, where required by applicable law. Government-imposed taxes may be added at checkout.

We try to avoid pricing errors, but mistakes can happen. If a product is listed at an incorrect price due to typographical error, technical issue, supplier error, or other mistake, we reserve the right to cancel or refuse the order and refund any amount paid.

Promotional pricing, sale pricing, discount codes, and special offers may be changed, limited, or ended at any time unless otherwise stated.

8. Order Acceptance

Placing an order does not mean your order has been accepted. Your order is an offer to purchase the items in your cart.

We may confirm receipt of your order by email, but we reserve the right to accept, refuse, cancel, or limit any order before fulfillment. Reasons may include stock errors, payment issues, suspected fraud, address issues, supplier allocation changes, pricing errors, shipping restrictions, or violation of these Terms.

If we cancel an order after payment has been processed, we will issue a refund for the cancelled portion of the order.

9. Payment

We accept the payment methods shown at checkout.

You represent that you are authorized to use the payment method provided. You agree to provide accurate billing and payment information.

Orders may be subject to fraud screening. We may request additional verification before shipping an order. If we cannot verify an order, we may cancel it and issue a refund.

We are not responsible for fees charged by your bank, card issuer, payment provider, or currency conversion service.

10. Pre-Orders

From time to time, Kami Collectables may offer products for pre-order.

Pre-order release dates, product details, quantities, and arrival dates are based on manufacturer, distributor, or supplier information and are estimates only. Release dates and delivery timelines may change.

Pre-orders are subject to supplier allocation. If we receive less inventory than expected, we may fulfill orders in the order we determine to be fair and reasonable, limit quantities, offer substitutions, or cancel and refund affected orders.

Unless otherwise stated on the product page, payment may be collected at the time the pre-order is placed.

If you order in-stock items together with pre-order items, we may hold the full order until all items are available unless you contact us and arrange separate shipping, which may require additional shipping charges.

Pre-orders may be final sale or subject to specific cancellation rules stated on the product page. Any such rule does not limit your rights under applicable consumer protection laws.

11. Shipping and Delivery

We ship to the locations shown at checkout. Shipping options, rates, and estimated delivery times will be provided during checkout where available.

Delivery estimates are not guaranteed unless expressly stated. Shipping delays may occur due to carrier delays, customs processing, weather, labour disruptions, high-volume seasons, incorrect addresses, payment verification, supplier delays, or other events outside our control.

You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed deliveries, or losses caused by incorrect or incomplete address information provided by you.

If a package is returned to us due to an incorrect address, failed delivery, refusal, or failure to pick up, we may charge additional shipping fees to resend the order. If the order is cancelled after being returned to us, original shipping charges may not be refundable unless required by law.

We may use Canada Post, UPS, FedEx, Stallion Express, courier partners, or other shipping providers at our discretion.

12. Lost, Stolen, or Damaged Packages

If your package appears lost, stolen, delayed, or damaged in transit, please contact us as soon as possible at sales@kamicollectables.ca.

For damaged packages, you must keep the original packaging, shipping box, packing materials, and damaged items, and provide photos if requested. This helps us file a carrier claim where available.

If tracking shows that an order was delivered to the shipping address provided at checkout, we may require you to check with the carrier, household members, neighbours, building management, concierge, parcel lockers, or local post office.

We will handle lost or damaged package issues in a reasonable manner and in accordance with applicable law. Remedies may include investigation, replacement, store credit, refund, or carrier claim support, depending on the circumstances.

13. International Orders, Customs, Duties, and Import Charges

For orders shipped outside Canada, you are responsible for any customs duties, import taxes, brokerage fees, tariffs, clearance fees, or other charges imposed by your country, state, province, or customs authority.

Kami Collectables is not responsible for delays caused by customs inspections or import processing.

If an international package is refused, abandoned, returned, or destroyed due to unpaid duties, taxes, customs issues, or import restrictions, you may be responsible for the original shipping cost, return shipping cost, carrier fees, and any non-recoverable charges.

14. Returns and Exchanges

We want you to be happy with your order, but trading card products require strict return rules because of tampering, resealing, market movement, and randomized product contents.

Unless otherwise stated, returns may be accepted only if:

1. Error was on our part, like wrong product, or product quantity;

2. The item is unopened, unused, factory sealed, and in the same condition received;

3. The item is returned with all original packaging, accessories, and contents;

4. The return is approved by us before being shipped back; and

5. The item is not marked final sale, clearance, special order, pre-order final sale, or otherwise non-returnable.

Opened sealed products, loose booster packs, mystery products, digital products, gift cards, sale items, special orders, and products damaged after delivery are final sale unless required by applicable law.

Return shipping costs are the customer’s responsibility unless the return is due to our error, such as sending the wrong item.

We reserve the right to refuse returns that are opened, altered, damaged, incomplete, late, sent without approval, or suspected of tampering.

Nothing in this Return Policy limits your rights under applicable consumer protection laws.

15. Wrong Item, Missing Item, or Order Issue

If you receive the wrong item, are missing an item, or there is another issue with your order, contact us at sales@kamicollectables.ca within 48 hours of delivery.

Please include your order number, a description of the issue, and photos of the package and items received.

If we confirm an error, we may offer a replacement, refund, store credit, missing item shipment, or other reasonable solution.

16. Chargebacks and Payment Disputes

If there is a problem with your order, please contact us first so we can try to resolve it.

You have the right to dispute unauthorized or improper charges through your payment provider where applicable. However, filing false, abusive, or bad-faith chargebacks may result in cancellation of orders, refusal of future sales, account suspension, and recovery of costs where permitted by law.

This section does not limit any legal rights you may have under consumer protection, credit card, or payment laws.

17. Promotions, Discounts, and Coupon Codes

Promotions, discounts, coupon codes, free shipping offers, giveaways, and store credits may be subject to additional terms.

Unless otherwise stated, promotions:

• Cannot be combined with other offers;

• Have no cash value;

• Apply only to eligible products;

• May be limited to one use per customer, household, account, or order;

• May be changed or cancelled at any time; and

• May not apply to pre-orders, special orders, clearance items, gift cards, taxes, or shipping.

We reserve the right to cancel orders or disable promotions where we believe there has been abuse, fraud, technical error, or unintended use.

18. Gift Cards and Store Credit

If Kami Collectables offers gift cards, digital gift cards, or store credit, additional terms may apply.

Gift cards are not redeemable for cash except where required by law. Gift cards should be treated like cash and may not be replaced if lost, stolen, or used without authorization, unless required by law.

In Ontario, most retail gift cards cannot expire, and restrictions or conditions must be clearly stated. Any Kami Collectables gift card terms will be interpreted in accordance with applicable law.

Store credit issued as a customer service gesture, refund alternative, promotion, or account adjustment may be subject to separate terms, unless applicable law requires otherwise.

19. Loyalty Rewards

If Kami Collectables offers a loyalty, points, rewards, or membership program, the program may be governed by separate terms.

Rewards may have no cash value and may be subject to limits, exclusions, earning rules, redemption rules, account requirements, and fraud prevention rules.

Any loyalty program will be interpreted in accordance with applicable Ontario consumer protection requirements. Ontario consumer protection rules have included restrictions on rewards points expiring due to the passage of time alone, subject to applicable exceptions and regulatory changes.

20. User Content, Reviews, and Submissions

If you submit reviews, comments, photos, videos, messages, social media tags, testimonials, feedback, or other content to Kami Collectables, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, repost, edit, and share that content for business, marketing, and promotional purposes.

You are responsible for any content you submit. You agree not to submit content that is unlawful, defamatory, abusive, misleading, infringing, obscene, discriminatory, spam, or otherwise harmful.

We may remove or refuse to display user content at our discretion.

21. Acceptable Use

You agree not to use our website or services to:

• Violate any law or regulation;

• Commit fraud or impersonate another person;

• Interfere with website security or functionality;

• Scrape, copy, or harvest website content without permission;

• Upload malware, harmful code, or spam;

• Abuse discounts, rewards, promotions, or referral programs;

• Place orders using false information;

• Harass, threaten, or abuse our staff, customers, or community; or

• Engage in activity that harms Kami Collectables or other users.

We reserve the right to restrict access, cancel orders, suspend accounts, or refuse service where we believe these Terms have been violated.

22. Intellectual Property

All website content, including text, graphics, logos, images, layout, design, product descriptions, banners, icons, videos, and other materials, is owned by Kami Collectables or used under licence, unless otherwise stated.

You may not copy, reproduce, distribute, modify, publish, sell, or exploit our website content without our written permission.

All third-party trademarks, trading card names, logos, character names, and brand names belong to their respective owners.

23. Privacy

Your use of our website and purchases from Kami Collectables are also governed by our Privacy Policy.

We collect, use, and disclose personal information as described in our Privacy Policy, including information needed to process orders, provide customer service, ship products, prevent fraud, and comply with legal obligations.

Canadian private-sector businesses that collect, use, or disclose personal information during commercial activity are generally subject to PIPEDA.

24. Marketing Emails and SMS

If you sign up for our newsletter, marketing emails, SMS messages, promotions, or other commercial electronic messages, you agree to receive those communications from Kami Collectables.

You may unsubscribe at any time using the unsubscribe link or instructions included in the message.

We will handle commercial electronic messages in accordance with Canada’s Anti-Spam Legislation, including applicable consent, identification, and unsubscribe requirements.

Transactional messages, such as order confirmations, shipping updates, customer service replies, and account notices, may still be sent where permitted by law.

25. Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, shipping providers, analytics tools, email platforms, social media platforms, embedded content, or external websites.

We are not responsible for third-party websites, services, policies, products, or content. Your use of third-party services may be governed by their own terms and privacy policies.

26. Product Safety, Storage, and Use

You are responsible for safely storing and using products purchased from Kami Collectables.

Trading card products may include small parts, wrappers, packaging, or accessories that may not be suitable for young children. Keep products and packaging away from children where appropriate.

We are not responsible for damage caused by improper storage, humidity, heat, sunlight, water, mishandling, or use after delivery.

27. No Investment or Financial Advice

Kami Collectables may provide product descriptions, market commentary, restock information, collectability discussions, or opinions about trading card products.

Nothing on our website or social media is financial, investment, resale, grading, or professional advice. Trading card values can rise or fall, and past market performance does not guarantee future results.

You are responsible for your own purchasing and collecting decisions.

28. Disclaimers

To the maximum extent permitted by law, our website and services are provided on an “as is” and “as available” basis.

We do not guarantee that our website will be uninterrupted, error-free, secure, or free from viruses or harmful components.

We do not guarantee that product descriptions, availability, pricing, images, or website content will always be complete, accurate, or current, though we will try to correct errors when discovered.

Nothing in these Terms excludes warranties, conditions, guarantees, or rights that cannot be excluded under applicable law.

29. Limitation of Liability

To the maximum extent permitted by law, Kami Collectables and its owners, employees, contractors, suppliers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, loss of data, loss of goodwill, loss of resale value, or loss of opportunity.

To the maximum extent permitted by law, our total liability for any claim related to a product or order will not exceed the amount you paid to Kami Collectables for the specific product or order giving rise to the claim.

This limitation does not apply where prohibited by law.

30. Indemnification

You agree to indemnify and hold harmless Kami Collectables and its owners, employees, contractors, affiliates, suppliers, and service providers from any claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms, misuse of our website, violation of law, fraud, or infringement of another person’s rights.

31. Force Majeure

We are not responsible for delays or failure to perform caused by events outside our reasonable control, including natural disasters, severe weather, labour disruptions, carrier delays, supplier delays, customs delays, pandemics, power outages, cyberattacks, government actions, war, civil unrest, or other events beyond our control.

32. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a new “Last Updated” date.

Changes apply going forward and do not retroactively change completed purchases unless permitted by law.

Your continued use of our website after changes are posted means you accept the updated Terms.

33. Governing Law

These Terms and any dispute arising from or relating to your use of our website, services, or purchases from Kami Collectables are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

Subject to any rights you may have under applicable consumer protection laws, you agree that disputes will be handled by the courts located in Ontario, Canada.

Nothing in these Terms limits any mandatory rights you may have under the consumer protection laws of your province, territory, state, or country of residence.

34. Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining parts will continue in full force and effect.

35. Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any other policies posted on our website, form the entire agreement between you and Kami Collectables regarding your use of our website and purchases from us.
